Mountainside New Jersey Appeals Attorney
Unless you are familiar with the Social Security application process you were probably devastated when you received your rejection notice. But most applications are initially rejected. A rejection is not an indication that your claim does not have merit or that it will not eventually succeed. Contact Newark, New Jersey, Social Security application attorney Agnes S. If you are just applying, the application process may seem simple. You can even apply online, but it is advisable that you obtain the assistance of an attorney experienced in applications, and appeal of claims. This can increase the likelihood of ultimate success, and more timely receipt of benefits.
The Process
The Social Security Administration will forward your application to a state agency if it meets basic criteria. The state agency makes a determination of eligibility. Factors considered in determining whether you are disabled and eligible include:
- Whether you are currently working
- Whether the medical condition is severe enough to render you disabled
- Whether the impairment is on a list of certain disabling impairments
- Whether you can do work you did before
- What other types of work you could do
It is very important to have the cooperation and support of your doctors. You must provide records of your medical history and impairment. The state agency returns the case to the federal SSA with its recommendation. The SSA usually adopts the state agency's disability determination.
Appeals
You only have 60 days to appeal a denial. This appeal is called a reconsideration. If you are not successful at this point, you have a right to a hearing before an administrative law judge (ALJ). An ALJ has more latitude than the initial decision makers to make allowances for your claim. Your chances are good if you have made it this far. If necessary, we can appeal to the Social Security Appeals Council. Finally, we can appeal to the federal courts. If you are ultimately successful, you will receive benefits for the time period of the appeals process.
