The Process

The Social Security Administration will forward your application to a state agency if it meets basic criteria. The state agency makes a determination of eligibility. Factors considered in determining whether you are disabled and eligible include:

An ALJ has more latitude than the initial decision makers to make allowances for your claim. Your chances are good if you have made it this far. If necessary, we can appeal to the Social Security Appeals Council. Finally, we can appeal to the federal courts. If you are ultimately successful, you will receive benefits for the time period of the appeals process.
